Release Agreement

Effective from:

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, COVENANT NOT TO SUE, AND INDEMNITY AGREEMENT

(hereinafter referred to as the "Release Agreement")

BY AGREEING TO THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN INJURY. PLEASE READ CAREFULLY.

1. Parties

This Release Agreement is entered into between:

1573171 B.C. LTD. DBA SPORTAMii ("Sportamii", "we", "us", or "our"), its directors, officers, employees, members, participants, spectators, instructors, guides, agents, volunteers, representatives, independent contractors, subcontractors, suppliers, sponsors, successors and assigns (collectively, the "Releasees"),

and the user of the Platform ("you" or the "Participant").

2. Definition

"Activities" includes any and all activities in which you participate in any way through your use of the Sportamii platform (website or mobile app), whether or not arranged by Sportamii.

This includes, but is not limited to:

Squash, running, hiking, cycling, climbing, swimming, surfing, skiing, snowboarding, fitness training, yoga, tennis, basketball, football, and other recreational or sporting activities.

3. Assumption of Risks

You acknowledge that participation in Activities involves inherent risks, dangers, and hazards, including but not limited to:

  • physical injury
  • death
  • property damage

You confirm that:

  • you are physically, emotionally, and mentally able to participate
  • you participate voluntarily and at your own risk

4. Release of Liability

You agree:

  1. To waive any and all claims against the Releasees for any loss, injury, damage, or expense, including death, arising from participation in Activities, including due to negligence.

  2. To release the Releasees from liability for any such claims.

5. Indemnity

You agree to:

  • indemnify and hold harmless the Releasees from any claims by third parties arising from your participation in Activities

6. Covenant Not to Sue

You agree that you will not bring any legal action against the Releasees for any claims covered by this agreement.

7. Binding Effect

This agreement is binding on:

  • you
  • your heirs
  • next of kin
  • legal representatives

8. Governing Law

This agreement is governed by the laws of the Province of British Columbia, Canada.

All disputes shall be resolved exclusively in the courts of British Columbia.

9. Acknowledgment

You confirm that:

  • you have read and understood this Release Agreement
  • you understand that you are waiving legal rights, including the right to sue
  • you agree to this agreement freely and voluntarily

10. Age Requirement

You confirm that you are at least 18 years of age.
